Terms of Use – Afrosmeet South Africa

1. Operator Information
Afrosmeet is operated by LBT Synergy, located at 34 avenue des Champs-Élysées, 75008 Paris, France.

2. Acceptance of Terms
By accessing or using Afrosmeet, you agree to comply with these Terms of Use and all applicable laws and regulations, including the Electronic Communications and Transactions Act (ECTA) No. 25 of 2002, the Protection of Personal Information Act (POPIA) No. 4 of 2013, and the Consumer Protection Act (CPA) No. 68 of 2008 of South Africa.
3. Eligibility
Afrosmeet is strictly intended for individuals aged 18 years or older. By creating an account, you confirm that you are at least 18 years of age. Accounts belonging to persons under 18 will be deleted immediately upon discovery. To report a minor: contact@afrosmeet.com
4. Account Registration
Users must provide accurate, current and complete information during registration. You are solely responsible for all activity conducted under your account. Accounts are personal and non-transferable.
5. Profile Photo Requirements
All profile photos must meet the following requirements:
- Photos must clearly show your own face — a real, recent and recognisable image of yourself.
- Photos of animals, objects, landscapes, cartoon characters or third parties are strictly prohibited.
- Using images that do not belong to you — including photos of celebrities, influencers or other real people — is prohibited and constitutes identity theft.
- AI-generated or heavily filtered images that misrepresent your appearance are not permitted.
Non-compliant profile photos will be removed and the account may be suspended without notice.
6. Prohibited Conduct — Zero Tolerance
The following are strictly prohibited on Afrosmeet and will result in permanent account suspension and blacklisting:
Fake Profiles & Identity Theft
Using another person's name, photos or identity to create a profile is strictly forbidden. Impersonation is a criminal offence under South African law (ECTA Section 45 and the Cybercrimes Act No. 19 of 2020). Such accounts are reported to the South African Police Service (SAPS) where appropriate.
Brouteurs / Romance Scammers
Creating an account with the intent to defraud, manipulate or extract money from other members is prohibited. This includes soliciting payments, gift cards, cryptocurrency or financial transfers under any pretext. Offenders are permanently banned and may be reported to the South African Police Service and the Information Regulator.
Routers & External Redirects
Creating a profile to redirect members to external platforms — WhatsApp, Telegram, Instagram, other apps or websites — is strictly prohibited. Router accounts are permanently banned and their phone number or email blacklisted to prevent re-registration.
Commercial & Escort Profiles
All forms of solicitation, escorting, prostitution or paid sexual services — whether explicit or implied — are strictly forbidden. Such profiles are permanently banned and may be reported to the relevant South African authorities, including SAPS and social welfare services.
Minors
Any account belonging to or targeting a person under 18 years of age will be immediately deleted. Users who knowingly interact with or solicit minors will be permanently banned and reported to the South African Police Service and, where applicable, the National Prosecuting Authority (NPA).
Harassment & Abusive Behaviour
Harassment, threats, hate speech, discrimination based on race, ethnicity, gender, sexual orientation, religion or disability, and any form of gender-based violence (GBV) are strictly prohibited and may be reported to the relevant South African authorities.
7. User Conduct
- Treat all members with respect and dignity.
- Do not post illegal, harmful or sexually explicit content.
- Do not attempt to compromise platform security or scrape data.
- Do not create multiple accounts to circumvent a suspension.
Users may report or block other users at any time. All reports are reviewed within 48 hours.
8. Moderation & Enforcement
Afrosmeet operates active human and automated moderation, 7 days a week. Accounts may be suspended without prior notice in cases of policy violation. Permanently banned accounts and their associated identifiers (email, phone number, device ID) are blacklisted to prevent re-registration.
9. Content Responsibility
Users are solely responsible for the content they publish on Afrosmeet. Afrosmeet may moderate, remove or flag content that violates these Terms or applicable South African law, including the Films and Publications Act and the Cybercrimes Act.
10. Privacy & Data Protection
Personal information is processed in accordance with our Privacy Policy, which complies with both POPIA and the GDPR.
11. In-App Purchases & Subscriptions
Afrosmeet offers optional premium features through in-app purchases and subscription plans.
- Subscriptions renew automatically unless cancelled before the renewal date.
- Billing and payment processing are handled through Apple App Store or Google Play Store.
- You may manage or cancel subscriptions directly through your app store account settings.
- Prices are displayed in ZAR (South African Rand) where applicable. All purchases are subject to the terms and refund policies of the respective platform provider.
- In accordance with the Consumer Protection Act (CPA) No. 68 of 2008, South African users have the right to cancel a subscription with 20 business days' notice.
- No refund will be issued if an account is suspended or banned for violation of these Terms.
12. Limitation of Liability
Afrosmeet does not guarantee specific outcomes, matches or results. We are not liable for indirect or consequential damages arising from use of the platform, including outcomes from in-person meetings. Users are encouraged to exercise caution and meet in safe public spaces.
13. Suspension & Termination
Accounts violating these Terms may be suspended or permanently terminated without prior notice. Serious violations will result in blacklisting and, where applicable, reporting to the South African Police Service (SAPS), the Information Regulator, or the National Prosecuting Authority (NPA).
14. Modifications
Afrosmeet may modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of France and are subject to the jurisdiction of the courts of Paris. South African consumer protection provisions under the CPA and ECTA apply concurrently for South African users, and where they provide greater protection, those provisions shall prevail.
